Lawsuit Against Splenda Moves Forward

federal courthouse, United states courthouse, lawsuit against splenda, splenda, artificial sweetenersA federal court has rejected a request for summary judgment in a lawsuit regarding claims of false advertising for the artificial sweetener Splenda. This means that the case will go ahead as planned.

The plaintiff in the case is the Sugar Association, which has long claimed that Splenda’s marketing slogan – “Made from sugar so it tastes like sugar” -- is being used to make consumers believe that the artificial sweetener contains natural sugar.

The manufacturers of Splenda (Johnson & Johnson, representing its subsidiary firm McNeil Nutritionals), requested a summary judgment on the grounds that the plaintiffs had unreasonably delayed bringing suit. This request was rejected, and the claims against Johnson & Johnson will be heard by a jury at a trial, which is now scheduled to begin on January 29, 2008.

Dr. MercolaDr. Mercola's Comments:

This trial will likely increase public knowledge about the fact that Splenda (sucralose) is not sugar, but rather an artificial sweetener in line with aspartame and saccharin, which will be a positive outcome. However, I doubt the real truth about Splenda’s health dangers -- which I go through in depth in my book, Sweet Deception -- will get out there.

Avoiding sugar is a crucial component of a healthy lifestyle, but, instead of doing so by consuming a naturally low-sugar diet based on whole foods, some people are still trying to have their cake and eat it too. As I emphasized in my previous NY Times best-selling book, The No-Grain Diet, it is not the carbs that are the major issue, it is the type of carbs. That's why the low-carb craze, which did not make this distinction, failed for many.

Splenda Causes Biochemical Distortions

Splenda, best known for its marketing logo, "made from sugar so it tastes like sugar,” has taken the sweetener industry by storm, becoming the number one selling artificial sweetener in the United States.

But consuming foods that contain artificially or naturally sweetened substances can cause serious distortions in your biochemistry. For example, if you drink diet soda in an attempt to lose weight, they won't help you. Instead, diet soft drinks can actually double your obesity risks!

Nearly a decade ago, studies were already revealing that artificial sweeteners can:

  • Stimulate your appetite
  • Increase carbohydrate cravings
  • Stimulate fat storage and weight gain

It’s amazing how long it can take for the truth to finally seep into your mind when you’re bombarded with misinformation through mass advertisements and clever PR campaigns directed at your doctors, who in turn advocate the use of these dangerous substances.

Splenda Has Never Been Proven Safe For Human Consumption

Many adverse reactions to Splenda are posted on our site. In fact, we have more people on our site that have reported adverse reactions to Splenda than were formally studied in the research submitted for FDA approval!

As of 2006, only six human trials had been published on Splenda (sucralose), and of those six trials, only two were completed and published before the FDA approved sucralose for human consumption. The two published trials had a grand total of 36 total human subjects. Of those, only 23 people were actually given sucralose for testing.  

Additionally, the longest trial had lasted only four days and looked at sucralose in relation to tooth decay, not human tolerance. They claim that over 100 studies have been conducted on Splenda. What they don't tell you is that most of the studies are on animals.

And, those animal studies reveal plenty of problems, such as: 

  • Decreased red blood cells -- sign of anemia -- at levels above 1,500 mg/kg/day
  • Increased male infertility by interfering with sperm production and vitality, as well as brain lesions at higher doses
  • Enlarged and calcified kidneys (McNeil stated this is often seen with poorly absorbed substances and was of no toxicological significance. The FDA Final Rule agreed that these are findings that are common in aged female rats and are not significant.)
  • Spontaneous abortions in nearly half the rabbit population given sucralose, compared to zero aborted pregnancies in the control group 
  • A 23 percent death rate in rabbits, compared to a 6 percent death rate in the control group 

Chemically, Splenda is More Similar to DDT Than Sugar 

Yes. Splenda bears more chemical similarity to DDT than it does to sugar. Sucralose starts off as a sugar molecule. However, sucralose is a synthetic chemical that was originally cooked up in a laboratory.  

In the five-step patented process of making sucralose, three chlorine molecules are added to a sucrose (sugar) molecule. A sucrose molecule is a disaccharide that contains two single sugars bound together, i.e. glucose and fructose. 

The chemical process to make sucralose alters the chemical composition of the sugar so much that it is somehow converted to a fructo-galactose molecule. This type of sugar molecule does not occur in nature, and therefore your body does not possess the ability to properly metabolize it. As a result of this "unique" biochemical make-up, McNeil Nutritionals makes its claim that Splenda is not digested or metabolized by the body, hence it has zero calories.

But, if you look at the research (which is primarily extrapolated form animal studies) you will see that in fact 15 percent of sucralose IS absorbed into your digestive system, and ultimately is stored in your body. To reach the average number of 15 percent means that some people absorb more and some people absorb less, depending on your biochemical makeup.  

And, if you are healthy and your digestive system works well, you may be at HIGHER risk for breaking down this product in your stomach and intestines. 

Are There Healthier Alternatives? 

If you have a craving for sweets, rather than trying to find "healthier" ways to continue indulging in them, it is in your best interest to learn ways to relieve your cravings.  

The obvious one would be to stop eating any of the products to begin with. But sweets are powerfully addictive – sugar has even been shown to be more addictive than cocaine. Stevia is a preferable natural substitute, which can be used in making most dishes and drinks. 

However, complete avoidance of sweets is often necessary to break your addictive cycle, as your hormones insulin and leptin likely play an important role in your cravings. To get you started, understanding how they work can be helpful. 

If you are unable to achieve abstinence from sweets, your emotional connection to cravings might be an important factor for you. One of the most profound methods I know of for diminishing the effects of food cravings is the Emotional Freedom Technique (EFT). EFT is the psychological acupressure technique I routinely use in my practice to help people reduce their cravings.

Don't be fooled by the apparent well doing of this Andy Briscoe.  "Consumers have a right to know what they are really buying..."   That he is fighting Splenda for the rights of consumers is merely subterfuge.  If sugar sales are falling, he has to blame someone.  He cannot go to his shareholders and boardmembers telling them, "maybe people are waking up to the fact that sugar is harmful?"
Oh nooooo.   He will look for a scapegoat to keep his high salaried job.  His scapegoat is Splenda.   This is nothing more than a palenque.

My wife and I went to a retreat this past summer where we were given a cabin to stay in. The cabin had cockroaches, a few of which came home with us. After a month or so we were seeing little baby cockroaches in the kitchen. I had remembered reading somewhere that Splenda was initially created as an insecticide so I thought to give it a try. I sprinkled some where I'd seen them crawling around and a month later realized that I hadn't seen any in awhile. Still haven't seen any. I can, therefore, highly recommend Splenda for this purpose.

Thank you so much for this information!  I have some old Splenda sitting in the closet.  I'd spent so much to buy it!  Now I know what to do with it!  I bought some aspartame specifically to get rid of ants, and it has worked, but if I am using it in our organic field, how can I call our stuff "organic" anymore?  I mean, aspartame and Splenda are pesticides!!

Recently visited somebody in a new hospital. They had a coffee, and tea bar in the waiting room. The sweetner was splenda. In the basement was a food court type situation with all the good things. Taco Bell, burgers, and pizza, among other junk food.

Is it any wonder that many are obese, and sick in the hospital?

I think the whole economy is built on trying to destroy the population after they take all their money. Then we hear all the rhetoric about health care from the politicians, and how they are going to make it better. They don't have a clue. Or maybe they do, and are lining their pockets as well.

Gotta love those hospitals.......I visited a friend who'd been just operated on for a brain tumor - guess what was on their hospital tray???? DIET COKE - freakin idiots in the hospitals is all I can say.  DUH - REPEAT AFTER ME - ASPARTAME HAS BEEN LINKED TO BRAIN TUMORS.....

I have a Chiropractor friend that has told me about Diet products years ago and about artificial sweeteners and I will tell anyone the same information he told me:

When looking at the word DIET, the first 3 letters of the word ought to tell you something!  "DIE"  in otherwords, IT'S NOT GOOD FOR YOU!!! and the same goes for all those other

ARTIFICIAL SWEETENERS!!!

For instants:

Mostly all chewing gum nowadays come with different artificial sweetening agents in them which are damaging your mouth, believe it or not.  When I use to chew gum, my teeth would hurt till I stopped chewing gum.  Their are just a few chewing gum companies that still use natural sugar in their products.  YOU MUST READ THE INGREDIENTS IN THE GUM BEFORE YOU BUY IT!

When a new product comes out on the market, the FDA doesn't always tested on the spot, folks!

It's usually 7 years later till they get around to testing it, by that time the damage is already being done to the consumer, the manufactures have made their money and the FDA says it not good for us to consume!

It's all about the money: The Pharmaceutical Companies and the Food and Drug Administration work hand-in-hand with each other to get what they want from the public and they don't care how they get it.

The almighty dollar is number 1.

So, BEWARE!

My old chiropractor told us, "If you want to be more alive than dead, eat foods that are more alive than dead." He wasn't telling us to gnaw body parts off of live animals, but to think about how far removed from living something is before we ingest it. If something was never alive, you probably shouldn't eat it.

I quit chewing gum because of the horrid aftertaste that the artificial sweeteners leave in my mouth. I've spit stuff out and told people that I didn't like the artificial sweetener only to have them argue with me that none were present. Guess who's always right? My taste buds know!

It doesn't matter who is behind bringing the lawsuit.  The truth is that Splenda ads lie and their product is visibly harmful to many people.  About 2 years ago, I went though a time of dizzy spells, nausea and headaches and the doctor couldn't find the cause.   While searching for anything different I was doing, I realized that I had been using Splenda for quite some time (a couple of years) and had not checked up on it.  I found Dr. Mercola's site on the Net.  Although most reactions to Spenda seemed to be rashes, depression and anxiety,  there was a small mention of dizzy spells and nausea.  I cold-turkeyed off Splenda immediately and symptoms disappeared, never to return.  That's all I needed to know.  However, I am so sick and tired of the Splenda ads which are misleading the public.  Anything that will publicize the deception is fine by me.

Chlorine is the key to Splenda's toxicity. One of the earliest uses of chlorine was to poison enemy troops: chlorine was in fact the first poison gas to be used in WWI. Chlorine is also found in 97 per cent of all pesticides. Chlorine is also the key element in Dioxin compounds, the most toxic chemicals known to science.

So, as already made public, splenda is synthesized by replacing three OH RADICALS in the C12H22O11 sugar molecule WITH 3 CHLORINE ATOMS. The result is a chloro-carbon molecule with a structure almost identical to dioxin molecules. No wonder it's not metabolized and has zero calories: it's a chloro-carbon poison ! ( as far as the body is concerned).

As time goes on,  it will eventually be revealed that in the process of producing Splenda, Dioxins are also produced as an unintended* by-product, because ALL USES OF CHLORINE LEAD TO DIOXINS.

(* or perhaps covertly "intended" ??)

what's with the scare tactic?  chlorine is also 50% of salt, atom for atom.  It's also in our drinking water for disinfection.

Of course chlorine is a poison, but it's also a vital element to us living.  Everything in balance.

If you're going to debate about splenda, don't resort to garbage like this.  By your logic we also should avoid water.

When Splenda first came out I thought it tasted better than Equal.  However, I rarely used either--mostly ingested them in diet soft drinks outside my home. In 2006 I joined Weight Watchers and stocked up on numerous Splenda-containing products. After a couple weeks I started noticing that I was experiencing episodes of light-headedness. This was frightening when it happened while driving--I hadn't fainted since I was a kid while having blood drawn after fasting, but I felt the same sensation and pulled over to the side of the road until it passed. My blood pressure was normal. It finally occurred to me that the only major change in my lifestyle since these episodes began was ingesting Splenda-containing products several times per day.  I stopped doing so and no more light-headedness, even though I still maintained a reduced calorie diet and was exercising.  A couple weeks later I re-challenged my system with Splenda and within a couple days the episodes of light-headedness returned.

When I read about the different toxic impacts of the various artificial sweeteners in the current food market, I get a mental image of a Monsanto executive, or some other Splenda executive sitting in a secret base in the South Pacific, petting a white cat on his lap. grinning evilly, and saying, " I do not expect you to sweeten your Tea, Mr. Bond, I expect you to DIE!

The perfectly natural craving for sweet sugar is intended by God to get people to eat lot's of wonderful ripe FRUIT. I eat one meal a day of ripe fruit only, usually for breakfast. I recommend it. High doses of natural antioxidant nutrients! It's not complicated.
